    The Department expect employees and others that we deal with, who have knowledge of serious allegations of fraud, corruption and maladministration about any aspect of the Department’s work to come forward and voice those allegations of fraud, corruption and maladministration

    Submit an unsolicited BID to the Department

    The National Treasury Circular No 11 of 2008/2009 guides the procurement process for unsolicited bids. If a bidder wants to submit an unsolicited bid – a proposal submitted outside of the normal procurement process – then bidder should note that:

    • The Department is not obliged to consider any unsolicited proposal.
    • Should the Department choose to consider a proposal, it may ONLY do so if:
      1. A comprehensive and relevant project feasibility study has established a clear business case for the proposal AND
      2. The product or service involves an innovative design; or the product or service involves an innovative approach to project development and management; or the product or service presents a new and cost-effective method of service delivery.

    The unsolicited proposal must be rejected if the product or service can, within reasonable and practicable limits, be acquired by conventional competitive bidding methods; if the proposal relates to products or services which are generally available; if the proposal does not fall within the institution’s powers and functions; if the proposal has not been submitted by a duly authorised representative of the proponent; or if the proposal contravenes the provisions of any law.

    Submit litigation involving the Department

    Should any member of the public or attorneys wishing to lodge any claim or demand in terms of Section 2 of the Institution of Legal Proceedings Against Certain Organs of State Act no 40 of 2002 against the Department of Public Works & Infrastructure for payment of damages or debt or for any other relief in terms of any other law, arising out of any contractual relationship, delict or any act or omission permissible in law, they are required to write to the Department of Public Works and Infrastructure by providing at least the following details:

    1. Brief summary of the facts giving rise to the Details of the facts giving rise to contractual claims for damages, delictual claims, any act or omission on the part of the officials of the Department, or any other relief permissible in law,
    2. Details of the contract, if the claims is based on contract, duly signed copies thereof,
    3. Details of the delictual claims if the claim is based on delict or an act or omission on the part of the Department,
    4. Brief summary of how the department is held liable for payment of damages, debt or the relief sought, and
    5. The amount of damages or debt owed or the specific remedy or relief sought from the Department.

    Any person who wishes to issue summons or court application for any order against the Department arising out of any breach of contract, delict or an act or omission for whatever relief permissible in law, especially after the Department has refused, neglected and or failed to meet the notice of demand served in terms of Section 2 of the Institution of Legal Proceedings Against Certain Organs of State Act no 40 of 2002, he or she shall do so by way of instructing the Sheriff of the Court to serve the summons or court application to the Department at the following address:

    Apply to reinstate a close-corporation

    1. The concern of the Department of Public Works & Infrastructure (DPWI) in any application to the Companies and Intellectual Property Commission (CIPC) for the reinstatement of a deregistered company or close corporation revolves around whether such entity was the registered owner of immovable property at the time of its deregistration, as such property became "bona vacantia" (ownerless property).

    2. With effect from 02 April 2013, DPWI has no role in applications for the reinstatement of a deregistered company or close corporation where such entity was not the registered owner of immovable property at the time of its deregistration. Applications for the reinstatement of such entities should be submitted directly to CIPC in accordance with CIPC Practice Note 6 of 2012. Applicants should note CIPC’ requirement that the deed search results in respect of all ten (10) Deeds Offices – to confirm that the deregistered entity does not hold immovable property anywhere in the country – must be included in their application to CIPC.

      Application in respect of a deregistered company or close corporation that was the registered owner of immovable property at the time of its deregistration:

    3. Under normal circumstances, DPWI would not oppose an application for the restoration of such a deregistered entity. DPWI would, however, reserve the right to claim compensation from the entity or its successors in title, for the payment of property rates, other municipal levies and any related expenses that may have been incurred by the Department in respect of any immovable property held in title by the entity at the time of its deregistration.

    To process such applications, DPWI requires the formal property description(s) and confirmation of the ownership of such property(s) in any of the following formats

    (a) recent print-outs from DeedsWeb (extracts from the electronic data base of the Deeds Office, obtainable over the counter from any Deeds Office or as a subscription service); or

    (b) recent print-outs from any recognised service provider (such as SearchWorks, WinDeed, LexisNexis] based on information extracted from the Deeds Office; or

    (c) recent certification by a Conveyancer to confirm the ownership of any properties held by the deregistered entity.

    4. Please note that “recent” constitutes information confirmed by the Deeds Office, recognised service provider or Conveyancer in the past thirty (30) days. The locality of the

    How many work opportunities has the programme created to date

    The homepage of the EPWP website (www.epwp.gov.za) has a tab named “EPWP M&E Reports”. EPWP quarterly reports reflect the work opportunities created under the EPWP and are loaded under the “EPWP M&E Reports” tab. The EPWP quarterly and annual performance since 2004 to date are included on the EPWP website.

    What is the target for EPWP Phase IV?

    The target for EPWP Phase IV is to create 5 million work opportunities over period of five years, 1 April 2019 up to 31 March 2024 (i.e. 2019/20 – 2023/24). The programme is targeting the participation of 60% women, 55% youth and 2% persons with disability.

    What is the minimum wage rate for EPWP

    The minimum wage rate for EPWP is gazetted by the Department of Employment and Labour through the National Minimum Wage Act No. 9 of 2018. Government Gazette No. 44136 of 8 February 2021 sets the EPWP minimum wage at R11, 93 per hour, which came into effect from 1 March 2021.

    What is the process of recruitment Participants into the EPWP projects?

    On 5 December 2017, the Minister of Labour approved the EPWP Recruitment Guidelines. The EPWP Recruitment Guidelines aim to ensure uniformity across all sectors in the process of recruitment of participants; provide guidance in the selection process and eliminate unfair and biased practices; provide a fair, transparent and non-ambiguous recruitment process and provide guidance to EPWP stakeholders on their roles and responsibilities. The EPWP Recruitment Guidelines may be obtained on the EPWP website (www.epwp.gov.za).

    How can I be part of EPWP

    Public bodies (national departments, state owned enterprises, provincial departments, and municipalities) or the relevant publicly appointed Implementing Agencies are responsible for the recruitment and selection of EPWP participants on each project. The implementing bodies will plan the recruitment process in consultation with local community leaders to ensure coordination, and if possible, combine recruitment for multiple projects.

    Work opportunities shall be communicated through various channels that optimise the effectiveness of reaching the intended participants. These may include: a) Flyers and notifications at local government offices and facilities, b) Existing community structures and communication channels, c) Existing or specially convened public meetings/gatherings, and d) Local community radio stations, newspapers, etc.

    The announcement should always specify how, where and when potential candidates can register or apply for work on relevant EPWP projects. In addition, employment conditions (including responsibilities, wages, entitlements, health and safety, and contract duration) should be made known before the recruitment begins. Once appointed, each participant must be issued with a written contract.

    Late payment of wages

    The Basic Conditions of Employment Act states that an employer must pay remuneration not later than seven days after: (a) the completion of the period for which the remuneration is payable; or (b) the termination of the contract of employment. Therefore a written employment contract between the participant and the employer will state when remuneration is payable. Hence, Public bodies are to ensure that participants receive their wages on time at the identified day of the month. Any complaints are to be directed to the Department of Employment and Labour.

    What is the duration of EPWP work opportunity

    The duration of work opportunity is mainly linked to the duration of the project. At the beginning of a project, participants should sign employment contracts which stipulate the start and the end date of the employment (this should be emphasised by Public bodies during induction of participants).

    Where can I report corruption within EPWP project?

    Government has streamlined the reporting of corruption and has established a National Anti-Corruption Hotline. The Hotline number is: 0800 701 701.

    To report allegations of corruption, please provide as much information and detail as possible, including who, what, when, where, why and how. For example,

    a. Who refers to the name(s) of the national department, provincial department or municipality involved, the names and rank of the persons at the national department, provincial department or municipality. Was he/she alone? Who else is implicated?

    b. What refers to a description of the allegation: Also highlight the name of the project, the location of the project, the nature of the project and the start and end date of the project.

    c. When did it happen? Provide dates, time and how often.

    d. Where did it happen? Mention the name of the department, province, street address and the name of the building/site.

    e. How did it happen? Given proof/evidence i.e. file number, amounts involved, etc.

    f. Demonstrate how the case can be investigated and how you can be contacted for further information.

    Where should an application for a disposal/servitude (except Human Settlements and Land Reform) on land under the custodianship of the Public Works and Infrastructure be submitted?

    An application for a servitude with supporting documents must be submitted to the relevant Regional Office.

    The application must have detailed information with a property description, extent of the servitude, purpose for which the servitude is required, period for which the servitude is required and a servitude diagram or draft sketch plan

    Which processes will be undertaken to address the application

    The Regional Office will confirm ownership and the availability of the land, current land use, confirm whether there are no land claim lodged against the property and the location of the servitude on the property. Once the aforementioned investigations are completed, a requests will be forwarded to Real Estate Investment Services Branch at Head Office to undertake an Investment Analysis and Valuation.

    All enquiries for land claims must be submitted to the Department of Agriculture, Land Reform and Rural Development through their Regional Land Claim Commission Offices.

    The relevant RLCC’s will submit requests to DPWI for all land parcels under the custodianship of DPWI required to settle verified claims.
